These Terms and Conditions (“Terms”) govern participation in the Airtime Radio Promotion (“Promotion”) offered by Buddy Industries (Pty) Ltd (“Buddy”, “we”, “us”, or “our”), in partnership with Future Media. By participating in the Promotion, you (“User”, “you”) agree to be bound by these Terms. If you do not agree to these Terms, please do not participate.
1.1
The Promotion runs from 00:00 on 1 December 2025 to 23:59 on 31 December 2025 (“Promotional Period”).
1.2
During the Promotional Period, Users who complete any eligible transaction of N$20.00 or more on the Buddy Super App will receive 5% cashback, awarded in the form of Smile$, Buddy’s in-app loyalty currency (“Cashback”).
1.3
Smile$ can be used within the Buddy Super App for purchasing airtime, electricity, food vouchers, products, services, or any other applicable features available in the app, subject to availability from time to time.
2.1
The Promotion is open to all registered Buddy Super App users with an active account in good standing.
2.2
Users must comply with all Buddy Super App Terms of Service and all applicable laws and regulations of the Republic of Namibia.
2.3
Buddy employees, contractors, and promotional partners may participate unless expressly excluded by internal policy or communication from Buddy.
3.1
A “Qualifying Transaction” means any completed transaction of N$20.00 or more on the Buddy Super App during the Promotional Period.
3.2
Qualifying Transactions include airtime purchases and any other products or services available on the app unless specifically excluded in an in-app notice or communication on the Buddy website.
3.3
Transactions that are cancelled, reversed, refunded, disputed, fraudulent, or otherwise not successfully completed do not qualify for Cashback.
3.4
Multiple Qualifying Transactions are permitted; Cashback is earned per Qualifying Transaction. Buddy reserves the right to impose a cap on Cashback at any time by notice in the app or on the website.
4.1
Users will receive 5% of the value of each Qualifying Transaction in Smile$.
4.2
Smile$ will be allocated to the User’s Buddy Super App account within five (5) minutes after the Qualifying Transaction is successfully completed. Allocation times may be affected by system or network delays.
4.3
Smile$ have no cash value, are non-transferable, and cannot be withdrawn, exchanged, or redeemed for cash or any other form of value outside the Buddy Super App.
4.4
Smile$ may be used only within the Buddy Super App for eligible products and services as may be made available by Buddy from time to time. Buddy may change the list of eligible products and services at its discretion.
4.5
Buddy reserves the right to adjust, withhold, or reverse Smile$ awarded in the event of error, system malfunction, suspected fraud, breach of these Terms, or ineligibility of the transaction or User.
5.1
Users are responsible for ensuring that their account details and transaction information are accurate before confirming a transaction.
5.2
Users must report missing or incorrect Cashback allocations to Buddy within 72 hours of the relevant transaction by contacting Buddy Support (details below). After this period, Buddy may, in its sole discretion, decline to investigate or adjust Cashback.
6.1
The Promotion is subject to the availability and proper functioning of the Buddy Super App and supporting systems.
6.2
Buddy will use reasonable efforts to ensure that Smile$ are allocated promptly; however, allocation may be delayed by technical issues, network failures, or third-party service interruptions.
6.3
Buddy is not liable for any loss or damage arising from downtime, system errors, or delayed Cashback allocation where such events are beyond Buddy’s reasonable control.
7.1
Buddy reserves the right, in its sole discretion, to disqualify any User from the Promotion and/or suspend or close any Buddy account where the User:

Buddy may reverse or cancel Smile$ credited to an account where such Smile$ were awarded in error or as a result of misuse, abuse, or technical malfunction.
8.1
Buddy reserves the right to amend, suspend, or terminate the Promotion or these Terms at any time, for any reason, with or without prior notice, subject to applicable law.
8.2
Any changes will be effective upon publication on the Buddy website and/or within the Buddy Super App. Continued participation in the Promotion after such changes constitutes acceptance of the amended Terms.
9.1
To the maximum extent permitted by law, Buddy, Future Media, and their respective directors, officers, employees, and agents shall not be liable for any indirect, consequential, or incidental loss, damage, or injury arising out of or in connection with the Promotion.
9.2
Nothing in these Terms operates to exclude or limit any rights or remedies that cannot be lawfully excluded or limited under applicable Namibian consumer protection laws.
10.1
These Terms are governed by and shall be construed in accordance with the laws of the Republic of Namibia.
10.2
Any disputes arising from or in connection with the Promotion shall be subject to the exclusive jurisdiction of the courts of Namibia.
